Terms & Conditions

1. GENERAL INFORMATION

The website www.lanadelemn.ro is operated by Viessmann Transilvania SRL, with its registered office at 30 Depozitelor Street, Târgu Mureș, Mureș County, Romania, registered with the Trade Register under no. J26/1236/2005, having VAT Identification Number RO17758655, hereinafter referred to as the “Seller”.

Accessing and using this website, as well as placing orders, constitutes acceptance of these Terms and Conditions.

2. PRODUCTS AND AVAILABILITY

The products offered through the website are presented in good faith. Product images are for illustrative purposes only and minor differences may exist between the images displayed and the delivered products.

All products are subject to availability.

3. PRICES

All prices displayed on the website are expressed in Romanian Lei (RON) and include VAT unless otherwise stated.

We reserve the right to modify prices without prior notice. The applicable price is the one displayed at the time the order is placed.

4. ORDER PLACEMENT AND CONFIRMATION

By placing an order, the customer confirms that all information provided is complete and accurate.

Submitting an order does not constitute automatic acceptance of that order. The contract is considered concluded only when the Seller confirms the order.

5. ORDER REFUSAL

The Seller reserves the right to refuse or cancel an order in the following situations:

• Product unavailable;
• Obvious pricing error;
• Incomplete or incorrect customer information;
• Suspected fraud;
• Inability to process payment.

6. DELIVERY

Products are delivered through partner courier companies.

Delivery times are estimates and may vary depending on product availability and the activity of the carrier.

The risk relating to the products passes to the buyer upon receipt of the goods.

7. RIGHT OF WITHDRAWAL

In accordance with Romanian Government Emergency Ordinance No. 34/2014, consumers have the right to withdraw from the contract within 14 calendar days from the date of receiving the product, without providing any reason.

To exercise the right of withdrawal, the customer must send a request to: info@lanadelemn.ro.

The consumer shall bear only the direct cost of returning the products, except where otherwise provided by law.

The right of withdrawal applies exclusively to individual consumers (natural persons).

8. RETURNS AND REFUNDS

Returned products must be in the same condition in which they were delivered.

The value of returned products will be refunded within a maximum of 14 days in accordance with applicable legislation. The Seller may postpone the refund until the returned products have been received or proof of shipment has been provided.

The direct cost of returning products shall be borne by the customer, except where otherwise provided by law.

9. COMPLAINTS AND WARRANTIES

Products benefit from the statutory legal guarantee of conformity in accordance with Romanian Government Emergency Ordinance No. 140/2021 regarding certain aspects concerning contracts for the sale of goods.

In the event of a lack of conformity, consumers are entitled to the rights provided by applicable legislation.

10. INTELLECTUAL PROPERTY

All content available on the website, including texts, images, logos, graphic elements and databases, is the property of Viessmann Transilvania SRL and is protected by applicable copyright laws.

11. PERSONAL DATA PROTECTION

Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and the Privacy Policy published on the website.

12. LIMITATION OF LIABILITY

The Seller shall not be liable for damages resulting from improper use of the products or for delays caused by external factors beyond its reasonable control.

13. DISPUTE RESOLUTION

Any disputes shall first be resolved amicably.

If an amicable settlement cannot be reached, disputes shall be submitted to the competent courts of Romania.
